TERMS OF SALE FOR PRODUCT PURCHASES

Along with the terms and conditions that govern your use of the Canadian Suzuki website (the “Site”), these terms of sale govern any orders or purchases you make on the Site and you agree to be bound by them. Suzuki Canada Inc. on its behalf and on behalf of its parent, its affiliates, third party service providers, and their successors and assigns, as applicable ("Suzuki") operates this Site. If you do not accept these terms of sale, do not order from the Site. Suzuki may modify the terms of sale and the terms and conditions applicable to this site, however, the terms of sale applicable to your order are the terms of sale in effect on the date you place your order. Any modification to the terms of sale will only apply to orders subsequently placed. Except as otherwise provided herein, changes will be effective when notice of the change is posted on the Site. Please check this Site regularly for changes to these terms of sale. You may print a copy of these terms of sale for your records.

 

1. Orders.

Suzuki is the supplier of any orders or purchases you make on the Site. The products displayed on the Site are offered for sale in Canada only and may not be available for purchase in your particular country or locality. We will not knowingly accept any order from a person under the age of majority in their respective province or territory of residence. You confirm that you are not under the age of majority in your respective province or territory of residence.

Product availability is subject to change at any time without notice and Suzuki makes no representations or warranties regarding product availability. Suzuki may, at its own discretion, limit or cancel quantities purchased per person, per household or per order.

Any order confirmation (electronic or paper receipt) given to you by Suzuki does not signify our acceptance of your order, nor does it constitute confirmation of an offer to sell. Suzuki reserves the right to revoke any stated offer, cancel orders, supply less than the quantity ordered at any time or to correct any errors, inaccuracies or omissions in any stated offer or price, including after an order has been submitted and whether or not the order has been confirmed and your payment processed. We will notify you if we are unable to accommodate your order.

Suzuki will work to ensure accuracy but does not guarantee the information made available on the  Site is correct, current or complete. You acknowledge that Suzuki will not be responsible for any loss, however arising, from the use of, or reliance on any such information.

If your payment has already been processed for the purchase when your order is cancelled, Suzuki will issue a credit to the payment method used in the amount of the charge. Individual credit card policies will dictate when this amount is credited to your account.

If you are not fully satisfied with your purchase, you may return it in accordance with

Suzuki’s Return Policy.

 

2. Pricing.

Prices of products on the Site are the Manufacturer’s Suggested Retail Price (“MSRP”) and are quoted in Canadian Funds. The MSRP does not include, if applicable, any title and registration fees, dealer pre-delivery and administrative charges, license fees, consumer rebates or incentives, dealer added options, destination and delivery charges, environmental charges or fees or any other additional costs. The MSRP is subject to change at any time without notice.

Suzuki dealers who sell the same products through their dealerships are under no obligation to sell any product or service at the prices posted on this Site and may sell for less. Suzuki is not responsible for the prices set by any dealer.

All Suzuki dealers are independent businesses authorized to sell Suzuki products. The dealers are not affiliates of Suzuki or any Suzuki affiliate.

 

3. Taxes.

All purchases are subject to tax based on Federal and Provincial legislation. All applicable taxes will be charged based on the ship-to location.

Certain products may be subject to provincial environmental handling or disposal fees. These fees vary by product and are collected by Suzuki and remitted to the stewardship organizations within their respective provinces. For more information on these individual programs, please visit your provincial stewardship organization's website.

 

4. Standard Return Policy.

If for any reason you are not satisfied, you may return an item covered by our Standard Return Policy within 30 days from the original date of purchase. Items that are being returned must be in new and unused condition. Additionally all original boxes, bags, packaging and literature must be in new condition and included with the returned product. Please make sure the items you wish to return meet these criteria prior to returning them.

All product returns require a Return Authorization (RA) number. Please contact our Customer Relations team to obtain the RA number. You are responsible for shipping the products back to us or you may return the product to your local Suzuki dealer. We recommend using a shipping method with tracking for your protection. Please be specific with regards to the reason of the return. A 15% restocking fee will be charged for all returns made to the Suzuki dealer or directly to Suzuki.

If the return is for defective products, products that were not described accurately, or incorrect orders, we will refund your shipping fees and not charge a restocking fee and we will arrange with you a replacement order.

5. Damaged, Missing & Lost Items.

All packages are inspected for damage before they ship from our warehouse. If your package has been damaged in transit, please contact us immediately. We must be informed of all shipping related claims within 48 hours after the package was received. We do not issue refunds for returns of damaged merchandise. An item that was discovered damaged upon receipt will be replaced with the same model only. Should the item not be available for replacement, you will be issued store credit for the original cost of the damaged item.

Suzuki is not responsible for any loss of products following shipment from Suzuki to your delivery address. Should your package be deemed lost in transit, please contact us immediately. An item that we deemed to be lost will be replaced with the same model only. We do not issue refunds for lost items. Should the item not be available for replacement, you will be issued store credit for the original cost of the lost item.

Please allow 1 to 8 days for the processing of claims for lost shipments.

 

6. Methods of Payment.

You may pay for your purchase using Interac, VISA, MasterCard, American Express, Discover Card through Chase Paymentech. You warrant that you are the cardholder and authorize Suzuki to charge the card for the price of the order. If the charge is rejected by the card issuer, Suzuki will have no obligation to ship or fulfill your order. All information provided Suzuki by you must be truthful and accurate.

 

7. Delivery / Pickup.

You have the option to have your order delivered to you or available for you to pick up at a participating Suzuki dealer.

Items to be delivered to you will be delivered to the address you specify in your order and will be shipped using a third party carrier. The specific third party carrier and their method of delivery will be identified in the order confirmation provided by Suzuki.

Items for Dealer pick up will be held at the dealer for up to 15 days from the date you receive notice that he item is available for pick up.  If the items are not picked up in accordance with this policy, the items will be returned to Suzuki in accordance with the Standard Return policy and charged the prescribed restocking fee.  For your protection and security, you must present either photo identification or another valid form of ID such as a Credit card.

 

8. General Provisions.

If any provision of these terms of sale are invalid or unenforceable under applicable law, then it shall be, to that extent, deemed omitted and the remaining provisions will continue in full force and effect. Unless specifically provided herein, these terms of sale along with the Site’s terms and conditions constitute the entire agreement between you and Suzuki with respect to your use of this Site and purchase of products. These terms of sale shall supersede all prior agreements, understanding, negotiations and discussions, either oral or written between the parties. There are no representations, warranties, conditions or other agreements, express or implied, statutory or otherwise, between the parties in connection with ordering from the Site except as specifically set forth herein. No waiver of any of the terms of sale will be of any force or effect unless made in writing and signed by a duly authorized officer of Suzuki. The section titles herein are for your convenience only and do not have any legal or contractual effect. These terms of sale shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You hereby expressly consent to the sole and exclusive jurisdiction and venue of the courts of the Province of Ontario, for any legal proceeding arising out of or relating to your ordering through the Site. A printed version of these terms of sale and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based on or relating to these terms of sale to the same extent and subject to the same conditions as other business documents and records executed and maintained in the original form in which they were generated.

 

9. Effective Date.

These terms of sale are effective as and from the effective date shown above. We encourage you to visit this Site frequently to view our most current terms of sale.
